Reports of “Nuclear Verdicts” have been greatly exaggerated by the media. In Weeks v. True, Sam Johnson recently obtained a defense verdict in Penobscot County Superior Court after the jury deliberated for a total of 19 minutes. The case involved an auto accident in which liability was not contested, but the causal connection between the claimed damages and auto accident were in dispute.
A $10,000.00 offer of judgment was submitted in advance of trial, which was rejected. The Plaintiff’s final demand was $100,000. Following a one-day trial, the jury found that none of the damages alleged by Plaintiff were related to the auto accident. All 9 jurors concurred in the verdict.
